Obama judge needs to go back to school and read the Constitution
President Donald Trump is battling another rogue District Court judge for using the Alien Enemies Act of 1798 to deport members of the Venezuelan prison gang Tren de Aragua.
Trump used the law to speed up the deportation of national security threats after he declared the gang a foreign terrorist organization.
D.C. District Court Judge James Boasberg, who was appointed by former President Barack Obama, issued a two-week restraining order on the use of the Alien Enemies Act and ordered two planes deporting Tren de Aragua members to El Salvador to turn around midflight and fly back home.
Activist judges like Boasberg decided that he was in charge of making decisions about foreign affairs and the country’s national security instead of the President.
Radio host Mark Levin said that Boasberg needed to go back to “judging 101” during an appearance on Fox News.
“Let me try to help this renowned radical left-wing judge. This is called Judging 101. If you want someone to do something, they need to understand what you want them to do,” Levin exclaimed.
He explained that the judge couldn’t snap his fingers and order the planes to turn around at the drop of a hat.
Boasberg questioned after the fact why the Trump administration didn’t have the planes return to the United States.
Levin argued the judge knew that he was being unreasonable to make the Trump administration’s life more difficult.
“He knows this. He’s a judge in the District of Columbia where the bureaucracy thrives. When you are a judge, Judge 101, you don’t just sit at the bench and say you know, you have to stop doing this and stop doing that,” Levin explained.
District Court judges are usurping the power of the President
The powers of the President under the Constitution are being hijacked by unelected dictators in black robes.
Trump was hit with more injunctions and temporary restraining orders in February than former President Joe Biden faced in the first three years of his term.
Levin warned that a constitutional crisis was coming unless the Supreme Court stepped in to stop these activist judges.
“This whole thing is becoming a sham. The American people are losing faith in the judiciary. We can’t have a judicial oligarchy of unelected judges at the trial court level who aren’t even in the Constitution telling the President what to do on human resources, on the border, on deporting criminal illegal aliens,” Levin said.
District Court judges have given themselves the authority to make sweeping policy decisions for the country.
“I mean, wait until we get to noncriminal illegal aliens. Can’t tell him he can’t look at payroll or data. What is it that the President can do? Martha, these are ministerial tasks, these are normal tasks for the President of the United States,” Levin concluded.
